Terms of Service — JotPro

These Terms of Service (“Terms”) govern your access to and use of the JotPro website, applications, AI writing tools, templates, APIs, and related services (“Service”). The Service is operated by Durant Digital LLC, a Wyoming company (“Company,” “we,” “our,” or “us”).

By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility & Accounts

You must be at least 16 years old to use the Service.

When creating an account, you agree to:

  • Provide accurate registration information

  • Maintain the security of your password

  • Be responsible for all activity under your account

  • Notify us immediately of unauthorized access

You may not use the Service if you are barred under applicable law.

2. Description of the Service

JotPro provides:

  • AI-powered writing tools

  • Content generation (blogs, outlines, articles, ads, emails, scripts, descriptions, etc.)

  • AI chat assistant

  • Image generation

  • Speech-to-text and text-to-speech tools

  • 50+ writing templates

  • SEO optimization tools

  • Multilingual writing support

  • API access for automation and autoblogging

  • Integration capabilities (Zapier, no-code platforms, scripts)

All outputs are generated automatically by AI and may be incorrect, inaccurate, or incomplete. You are solely responsible for verifying accuracy before use.

3. AI-Generated Content Disclaimer

The Service produces AI-generated text, images, audio, and other outputs (“Generated Content”).
You acknowledge that:

  • Generated Content may be inaccurate, biased, incomplete, or harmful if used improperly

  • Generated Content is not professional, legal, financial, or editorial advice

  • You must review all content before publishing or distributing

  • You are fully responsible for how Generated Content is used

The Company disclaims all liability arising from reliance on AI-generated output.

4. User Responsibilities & Acceptable Use

You agree not to use the Service to:

  • Create illegal, harmful, defamatory, or infringing content

  • Generate disallowed or harmful instructions

  • Violate copyright or intellectual property laws

  • Misrepresent AI content as human-verified fact

  • Train competing AI systems using JotPro outputs

  • Resell JotPro content unless permitted under a plan

  • Attempt to reverse-engineer or scrape AI systems

  • Share API keys or bypass usage limits

  • Exploit speech-to-text, text-to-speech, or image tools in prohibited ways

You must use the Service ethically and legally.

5. Intellectual Property

The Service, templates, UI/UX, branding, models, tools, and internal systems remain the exclusive property of the Company.

You may use Generated Content for personal or commercial purposes unless explicitly restricted by your subscription tier.

The Company retains the right to:

  • Improve its models using anonymized usage data

  • Revoke access for violations

  • Modify or discontinue features at any time

6. Subscriptions, Billing & Payments

JotPro offers subscription plans including:

  • Basic

  • Plus

  • Business (API)

You agree that:

  • Subscription fees are billed in advance

  • All charges are non-refundable unless required by law

  • Plans auto-renew unless canceled

  • Usage limits (words, images, audio generations, chat threads) are enforced automatically

  • Upgrading or downgrading may adjust billing accordingly

Payment processing is handled by Stripe or the platform through which you subscribed.

You authorize the Company and its payment processor to store payment methods and charge recurring fees.

7. API Access & Autoblogging Features

If your plan includes API access, you agree:

  • Not to misuse or overload endpoints

  • Not to use JotPro to generate harmful automated content

  • Not to circumvent rate limits

  • That you are responsible for any automated publishing, Zapier workflows, autoblogging pipelines, or batch content systems you create

The Company is not liable for:

  • SEO penalties

  • Platform bans

  • Publishing errors

  • Automated misuse

You are responsible for compliance with all platform policies (Google, WordPress, Shopify, Medium, affiliate platforms, social media, etc.).

8. Speech-to-Text & Text-to-Speech Tools

You agree not to:

  • Upload copyrighted audio without permission

  • Generate misleading or fraudulent audio

  • Misuse transcriptions or audio outputs for impersonation

Accuracy is not guaranteed.

9. Image Generation Tools

You may generate images using JotPro’s AI image services, subject to:

  • No creation of harmful, illegal, explicit, or copyrighted likenesses

  • No training external models using output

  • No misrepresentation of generated images as real photographs

10. Content Ownership

You own all Generated Content, subject to:

  • These Terms

  • Your subscription plan

  • Compliance with applicable law

  • The fact that content may not be unique or exclusive

The Company does not claim ownership over your generated text, images, or audio.

11. Termination

The Company may terminate or suspend your account immediately for:

  • Violating these Terms

  • Abusing the Service

  • Payment failure

  • Suspicious or fraudulent activity

  • Misuse of API access

Upon termination, access ceases immediately and no refunds are issued.

12. No Warranty

The Service is provided “as is” and “as available.”

We do not guarantee:

  • Accuracy

  • Reliability

  • Suitability

  • Error-free performance

  • Uptime or availability

  • That AI will generate correct or complete responses

You use the Service at your own risk.

13. Limitation of Liability

To the fullest extent permitted by law, the Company is not liable for:

  • Inaccurate or harmful AI-generated content

  • Lost revenue, profits, or business loss

  • Damages from automated systems or publishing pipelines

  • Third-party platform actions (bans, flags, removal, penalties)

  • Data loss

  • Any indirect, incidental, or consequential damages

Total liability is limited to the amount paid in the preceding 12 months.

14. Governing Law

These Terms are governed by the laws of the State of Wyoming, USA.
All disputes must be resolved exclusively in Wyoming courts.

15. Modifications to Terms

We may update these Terms at any time.
Continued use of the Service constitutes acceptance of revised Terms.
